The HOA Law: HOA conflicts are so common, and the cases have gotten so costly and entangled that there are precisely hundreds of laws in each state meant to cover the rights of both the HOAs and the individuals.
Sadly, this is where the interpretation of the law can emerge primarily. For example, let us say a peace-sign-shaped Christmas yard decoration was an alleged violation of HOA rules. Some residents translated this as an anti-war statement or as evil satanic in nature. The homeowner was fined 50 dollars a day until…finally removed it. If they purposefully chose to ignore the fines, this could have provoked a lien filing against their home.
As the board members change, which they often do, new members can choose to bring in a new set of rule definitions that everyone is expected to obey. Also, there’s always the occasionally broken car mechanic who creates new rules necessary. Within just a few years of an HOA’s formation, the list of residents’ rules can become quite lengthy.
